San Francisco Is Suing Trump Over Sanctuary City Order

The City Attorney of San Francisco announced on Tuesday that he’s suing Donald Trump. In the announcement he said the president doesn’t understand the Constitution as it relates to executive orders and sanctuary cities.

In a news conference at City Hall in San Francisco, Dennis Herrera said, “The president’s executive order is not only unconstitutional, it’s un-American. That is why we must stand up and oppose it. We are a nation of immigrants and a land of laws. We must be the ‘guardians of our democracy’ that President Obama urged us all to be in his farewell address.”

San Francisco has been a sanctuary city since 1989 and the lawsuit announced Tuesday will make it the first city in the country to sue over the Trump order.

On Monday, the state of Washington’s Attorney General sued the president over the same issue according to the Associated Press and others.

The suit from San Francisco alleges that Donald Trump is violating the Tenth Amendment because the president is seeking to coerce local authorities into abandoning what are known as “sanctuary city” laws and policies.

The city is specifically challenging Trump’s Jan. 25 executive order called “Enhancing Public Safety in the Interior of the United States.”

That act directed the Attorney General and the Secretary of Homeland Security to ensure that sanctuary cities do not receive federal money.
