In Major Set Back To Trump Administration, 9th Circuit Court Rules 3-0 against Muslim-ban

In what is a major set back to Donald Trump’s Muslim-ban, the 9th Circuit Court of Appeals has maintained the freeze on the controversial immigration order, meaning previously barred refugees and citizens from seven Muslim-majority countries can continue entering the U.S.

The Appeals court ruled 3-0 in favor of upholding the earlier court ruling.

This means that the Department of Homeland Security soon suspended all enforcement of Trump’s controversial directive.

The court rejected arguments from the Trump administration that the government would be “irreparably harmed” if the judicial system reviewed President Donald Trump’s Muslim-ban wasn’t allowed to continue. The Trump administration claimed that the president’s authority over national security matters allowed the ban. However, the U.S. Court of Appeals for the 9th Circuit determined that the judiciary has a proper role in safeguarding people’s rights.

The court said, “To the contrary, while counseling deference to the national security determinations of the political branches the Supreme Court has made clear that the Government’s authority and expertise in [such] matters do not automatically trump the Court’s own obligation to secure the protection that the Constitution grants to individuals, even in times of war.”

“There is no precedent to support this claimed unreviewability, which runs contrary to the fundamental structure of our constitutional democracy,” the court said.

Donald Trump responded to the court via twitter saying in alls caps, “SEE YOU IN COURT, THE SECURITY OF OUR NATION IS AT STAKE!”

The Appeals court’s decision keeps in force the lower court’s ruling that Donald Trump’s order can not be enforced.
